Court Injunctions

Any victim of domestic violence or harassment is left feeling unprotected and in need of competent support and guidance.

Our solicitors are extremely experienced in dealing with cases of abuse and will bring a Practical and Professional perspective to cases dealing with violence, while maintaining a sensitive approach and respecting the circumstances surrounding the procedure. The Family Law Act 1996 provides remedies for victims of domestic abuse. The victim must apply to the court, which will make one or both of the following orders to protect the victim:

  • Non-Molestation Order
  • Occupation Order

A Non-Molestation Order is an official demand from the court to stop one person pestering, threatening or being violent to another person. This includes behaviour such as stalking and harassing phone calls.

An Occupation Order is related to residence of a property. It can oblige one person to move out, even if the victim has already been forced to leave but wishes to return, or it may state that the offender may not enter or go within a specific distance of the property.

Restraining Orders

In cases where the victim is considered to be in danger, the court will attach a power of arrest to the order, which means that if the order is breached the offender can be arrested without the victim having to apply again to the court.

Protection from Harassment Act

Another option is the Protection from Harassment Act 1997, which provides protection for people who are being harassed by ex-partners. In this case the court can impose conditions of bail, which have a similar effect to that of a non-molestation order.
