Employer Protection against Legal Action

As an employer you may feel protected by establishing a policy of compromise agreements with employees.

A compromise agreement is a contract between an employer and an employee that is set up to prevent the employee bringing specific legal action against the employer relating to the termination of employment.

The document is highly specific and it is important that you have a specialist legal advisor to ensure that the contract covers all the required provisions. It must comply with an employee's legal rights to independent specialist advice, and usually includes terms covering the following areas:

  • Payments owed to the employee, for wages or expenses
  • Compensation agreed between the two parties
  • Affirmation that the employee has obtained independent legal advice
  • Any contribution by the employer to legal costs
  • The employee's responsibility to return any property belonging to the company
  • Any responsibilities of the employee effective after the date of termination of employment, such as confidentiality and non-competition
