Grounds for Divorce
There are five circumstances that the court will consider grounds for granting divorce:
- Adultery, where the respondent usually admits the offence, or the petitioner's solicitor must present evidence to prove it.
- Unreasonable behaviour, which can cover all sorts of circumstances.
- Desertion for two years, if the respondent has left the petitioner without their agreement and without good reason
- Two years of separation, when the parties have lived apart for two years and both consent to the divorce
- Five years of separation, in the event that the parties have lived apart for five years but one party is not in agreement.
If the divorce is not complicated and both parties are in agreement about the more complex financial and family issues, Proceedings can be Completed in a Period of 5 - 8 Months, from initial application to Decree Absolute.
