The law stipulates that employers must take Reasonable Steps to enforce these regulations, which in addition to the Legal Responsibility includes an Implied Responsibility to implement any measures deemed necessary for the health and safety of employees, even if these are not specifically written in law.

In the case that an employer breaches these statutory obligations and is found by a tribunal to have been negligent, they can face payment of compensation to injured employees. The civil courts can be very harsh on negligent employers, and if the case is judged to be a matter for the criminal courts, employers found guilty of negligence can be fined or even imprisoned.
