Health and Safety law comprises a very broad spectrum of specifications, and as a result of membership to the European Union six further regulations have also been recently incorporated into British law:

  • Employers are obliged to carry out a Risk Assessment on the place of work and act accordingly
  • The work premises must be regularly and adequately maintained
  • Dangerous machinery must be correctly guarded and protected
  • Equipment, stocks, materials etc must be correctly handled and used
  • Protective clothing and equipment must be worn where necessary
  • Employers must take necessary measures to prevent repetitive strain injury, eye problems and other injuries in the use of technological machinery

Health & Safety Rights & Responsibilities

The law stipulates that employers must take Reasonable Steps to enforce these regulations, which in addition to the Legal Responsibility includes an Implied Responsibility to implement any measures deemed necessary for the health and safety of employees, even if these are not specifically written in law.

Breach of Health & Safety Regulations

In the case that an employer breaches these statutory obligations and is found by a tribunal to have been negligent, they can face payment of compensation to injured employees. The civil courts can be very harsh on negligent employers, and if the case is judged to be a matter for the criminal courts, employers found guilty of negligence can be fined or even imprisoned.
